On Dec. 4, 1912, Officer Dye pursued a suspect into a barn and then up into a hayloft. After apprehending the suspect and while descending the ladder, a rung broke and Officer Dye fell and fractured his femur. He was taken to Mercy Hospital in Hamilton where he was admitted. By February 1913, gangrene set into the leg. Doctors amputated his leg, but he died three weeks later on March 21, 1913.
Officer Dye left a wife, Emma (37) and three children, one of which was Howard (10). Officer Dye, on March 24, 1913, was buried in Woodside Cemetery in Middletown, Ohio.
